These Terms of Service ("Terms") are an agreement between you and Sweet N Simple Home LLC ("we," "us," "our") governing your use of BirdieCut ("the app"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, please do not use the app.
01The service
BirdieCut is a tool that helps you import, mark, edit, and automatically stitch golf videos into a highlight. We work to provide a simple, easy-to-use editing experience.
02Use of the app
You are responsible for your use of the app on your device, and you agree to use it lawfully and appropriately. BirdieCut has no account system; access is tied to your device.
03Your content
- The videos and content you import and create remain yours. We claim no ownership of them.
- You represent that you have the rights to the content you import and that it does not infringe anyone's copyright, likeness, privacy, or other rights.
- You may not use the app to process, create, or distribute content that is unlawful, infringing, or otherwise harmful. You are solely responsible for any disputes or liability arising from your content.
04Intellectual property
The app itself — including its software, interface, design, name, and logo — is owned by Sweet N Simple Home LLC and protected by law. You may not copy, modify, decompile, reverse-engineer, or use it for any commercial purpose without our prior written permission.
05Prohibited conduct
- Reverse-engineering, decompiling, or attempting to extract the source code of the app.
- Using the app for any unlawful activity.
- Interfering with or disrupting the normal operation or security of the app.
06Disclaimers & limitation of liability
The app is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. To the extent permitted by law, we are not liable for data loss, file corruption, or other indirect damages arising from your use or inability to use the app. Please back up any files that matter to you.
07Changes & termination
We may update, change, suspend, or discontinue some or all features of the app to keep improving it, and will make reasonable efforts to provide notice of significant changes. We may also update these Terms; the updated version will be posted here with a revised "Last updated" date, and your continued use after it takes effect constitutes acceptance.
08Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute will first be addressed through good-faith discussion; if unresolved, it will be subject to the courts located in that state.
